Refund & Cancellation Policy
Version 3.0 — Effective date: 24 July 2026 (last updated 31 July 2026)
This Refund & Cancellation Policy explains how cancellations and refunds work for paid subscriptions to AI Game Dev (ai-game.dev). It forms part of our Terms of Service. The Service is operated by Ivan Murzak (trading as Modalith) (13205 97th Ave NE, Kirkland, WA 98034, USA) (the "Provider").
Who sells you the purchase. From the effective date of this Policy, paid subscriptions and prepaid-balance top-ups bought through our checkout are sold by Paddle (Paddle.com Inc., Paddle.com (Canada) Ltd or Paddle.com Market Limited, depending on your country — see Section 1.1 of our Terms of Service) acting as the merchant of record. Paddle takes the payment, issues the invoice or receipt, handles applicable taxes, and — as seller of record — executes and must approve refunds and payment disputes for those purchases. Refunds are therefore issued on Paddle's rails, and Paddle's own Refund Policy applies in addition to this Policy. Nothing in Paddle's terms or in this Policy removes the statutory rights described in Sections 2 and 8.
Transition — purchases made before the effective date. Subscriptions and top-ups purchased before the effective date of this Policy were sold with the Provider as merchant of record and payments processed by Stripe. Those purchases are not migrated: they keep that arrangement — the Provider remains merchant of record and refunds for them continue to be issued by the Provider through Stripe — until the subscription is cancelled or otherwise ends. The refund rights described below are the same either way; only who executes the refund differs.
How the charge appears on your statement. A purchase sold by Paddle shows on your card or bank statement as PADDLE.NET* MODALITH, not as "AI Game Dev". Charges for legacy subscriptions continue to show the previous descriptor. If a line item looks unfamiliar, please check for that descriptor and contact us before opening a dispute (see Section 7).
1. Subscriptions and Auto-Renewal
Paid plans are billed monthly or annually and renew automatically until you cancel. You can review your plan and billing period at any time on the Pricing page and in your account dashboard.
1a. Prepaid Balance (Wallet) Top-Ups
Separately from your subscription, you may add a prepaid balance ("wallet") that funds extended usage after your monthly plan allowance is used up. Each top-up is a one-time charge (not a subscription and not auto-renewing). See Section 7.10 of our Terms of Service for how extended usage and the +40% markup work.
- Paid balance is refundable. Any unused paid wallet balance — the amount you actually paid for and have not yet spent — is refundable on written request (see Section 6, "How to Request a Refund"). The unused paid portion is refunded to your original payment method — by Paddle as merchant of record for top-ups bought on or after the effective date of this Policy, and by the Provider through Stripe for earlier ones. Any tax is adjusted automatically by whichever of them is the merchant of record for that purchase.
- Bonus balance is non-refundable. Promotional credit — including the one-time first-top-up +20% bonus — is a gratuity, not paid consideration. Bonus balance is non-refundable, has no cash value, and cannot be exchanged for money or transferred.
- Order of spending. Your paid balance is always spent before your bonus balance, so a refund of unused paid balance is never reduced by bonus spending.
2. EU/UK 14-Day Right of Withdrawal
If you are a consumer in the European Union or the United Kingdom, you normally have 14 days from the start of your subscription to withdraw from the contract for a digital service. A prepaid-balance top-up is a separate purchase with its own 14-day window — see Section 2a.
Because AI Game Dev is a digital service that is made available to you immediately:
- When you start using the paid Service within the 14-day period, you expressly request and consent to immediate performance of the Service before the withdrawal period ends; and
- You acknowledge that you lose (or limit) your right of withdrawal to the extent the Service has already been performed. In practice this means you will be charged proportionately for the AI usage you have already consumed (the tokens and compute time used, valued as described in Section 3), and the unused remainder — if any — is refunded.
If you have not started using the paid Service and you withdraw within 14 days, you are entitled to a full refund of that billing period.
2a. Top-Ups Have Their Own 14-Day Window
A prepaid-balance top-up (Section 1a) is not part of your subscription. It is a separate one-time purchase of the same immediately-supplied digital service. If you are a consumer in the EU or the UK, each top-up therefore carries its own 14-day right of withdrawal, running from the date of that top-up — including a top-up bought part-way through a subscription period, or long after the subscription itself started. The withdrawal window for a top-up is never shortened or used up by the age of your subscription.
The same rules as in Section 2 apply to it. Before the payment you are asked to expressly request immediate performance of the topped-up usage credit and to acknowledge that you lose your right of withdrawal to the extent it has already been performed. If you then withdraw within those 14 days, you are charged for the AI usage you actually consumed out of that top-up (calculated as described in Section 3) and the unused paid remainder is refunded. If you have not spent any of the top-up, you are entitled to a full refund of it. Bonus balance is a gratuity rather than paid consideration and is not refundable (Section 1a).
3. How Proportionate Charges Are Calculated
When the right of withdrawal is exercised after performance has begun, the amount you owe is the value of the AI usage you actually consumed up to the moment of your withdrawal request. Your usage is metered request by request and counted in money; the amount you owe is that metered usage, valued at the same rate at which it is counted against your plan allowance. We deduct that amount and refund the rest of what you paid. Any tax is adjusted automatically by the merchant of record for that purchase — Paddle for purchases sold by Paddle, the Provider through Stripe Tax for legacy purchases.
Your plan allowance does not set the charge. The usage allowance included in a paid plan is a rolling 30-day allowance, and it is the same whether you pay monthly or annually — paying for a year buys you twelve months of access, not a twelve-times-larger allowance to draw down. So the amount you owe on withdrawal is never calculated by applying the share of one month's allowance you used to the price of a whole year.
Worked example. You buy an annual plan and withdraw a week later, having consumed AI usage worth $12 at the rate your usage is metered. You owe $12, and the rest of what you paid for the year is refunded (tax adjusted automatically). If instead you had used nothing, you would owe nothing and receive a full refund.
4. Cancellation (Stopping Auto-Renewal)
You can cancel your subscription at any time from your account dashboard.
- Cancelling stops future automatic renewals.
- Your paid access continues until the end of the billing period you have already paid for; it is not cut off immediately.
- Cancellation by itself does not trigger a pro-rata refund of the current period beyond any mandatory statutory right (such as the EU/UK withdrawal right described above). After the period ends, your account reverts to the free tier.
5. United States and Other Regions
Outside the EU/UK, there is generally no statutory cooling-off right for digital services. For customers in the United States and other regions, refunds are offered at our discretion. We aim to be fair: if you experience a genuine problem (for example a billing error or a material service fault), contact us and we will review your situation. In all cases, cancellation is easy and self-service from your account dashboard so you are never locked into a renewal you do not want.
6. How to Request a Refund
To request a refund or exercise your withdrawal right, contact us at support@ai-game.dev (or via the contact options below) with the email address on your account and a brief description of your request. You may also contact Paddle's buyer support directly for a purchase Paddle sold you — either route reaches the same outcome.
Approved refunds are issued to your original payment method. For purchases sold by Paddle as merchant of record, the refund is executed by Paddle and requires Paddle's approval as seller of record, in line with Paddle's Refund Policy as well as this Policy; for legacy purchases the Provider issues the refund through Stripe. Where you have a statutory right to a refund (Section 2), that right applies regardless of which rail the purchase was made on, and we will support your request with Paddle. Processing typically takes 5–10 business days to appear on your statement, depending on your bank or card issuer. Any applicable tax is refunded together with the refunded amount and adjusted automatically by the merchant of record for that purchase.
7. Chargebacks and Disputes
If you believe a charge is incorrect, please contact us first — we can usually resolve billing issues faster than a formal dispute. Remember that a purchase sold by Paddle appears on your statement as PADDLE.NET* MODALITH, which is the most common reason a charge looks unfamiliar.
If you open a chargeback or payment dispute with your bank or card issuer, the dispute is handled by the merchant of record for that purchase — by Paddle for purchases Paddle sold, and by the Provider through Stripe for legacy purchases — and we may be required to suspend access to paid features while it is investigated.
8. Your Statutory Consumer Rights
Nothing in this Policy limits or excludes any mandatory statutory rights you have as a consumer that cannot be waived under the law of your country of residence. Where this Policy conflicts with such a right, that mandatory right prevails to the extent of the conflict.
