Terms of Service
Version 3.0 — Effective date: 24 July 2026 (last updated 31 July 2026)
Welcome to AI Game Dev (ai-game.dev). These Terms of Service (the "Terms") govern your access to and use of the AI Game Dev website, hosted Model Context Protocol (MCP) server, account dashboard, command-line tools, and any paid subscription plans (together, the "Service"). By accessing or using the Service, or by checking the acceptance box at sign-up, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who We Are (Trader Identity)
The Service is operated by Ivan Murzak (trading as Modalith), a sole proprietorship, located at 13205 97th Ave NE, Kirkland, WA 98034, USA (the "Provider", "we", "us", or "our"). The Provider supplies the Service to you under these Terms and is the controller of your account data (see our Privacy Policy). You can reach us at support@ai-game.dev or via the contact details at the end of these Terms.
1.1 Seller of record for paid transactions
From the effective date of these Terms (Version 3.0), paid subscriptions and prepaid-balance top-ups bought through our checkout are sold to you by Paddle (the Paddle group company that acts as merchant of record for your country — Paddle.com Inc., 3811 Ditmars Blvd #1071, Astoria, New York, NY 11105-1803, USA, for buyers in the United States; Paddle.com (Canada) Ltd, 22 Adelaide Street West, Suite 3400, Toronto, Ontario, M5H 4E3, Canada, for buyers in Canada; and Paddle.com Market Limited, registered in England and Wales, company no. 08172165, 30 Old Bailey, London EC4M 7AU, United Kingdom, for buyers everywhere else. The company that sold to you is named on your receipt and invoice) acting as the merchant of record. This means Paddle — not the Provider — is the seller of record for that transaction and is responsible for taking payment, for calculating, collecting and remitting any applicable taxes, for issuing the invoice or receipt, and for processing refunds and payment disputes. Purchases made through the Paddle checkout are additionally subject to Paddle's Checkout Buyer Terms and Paddle's Refund Policy, which apply in addition to — and do not replace — these Terms and our Refund & Cancellation Policy. The Provider remains your counterparty for the Service itself, for support, and for your account.
Transition — purchases made before the effective date. Subscriptions and top-ups purchased before the effective date of these Terms were sold with the Provider as merchant of record and payment processed by Stripe. Those purchases are not migrated: an existing subscription continues to renew on that original basis — Provider as merchant of record, Stripe as payment processor, tax calculated and remitted by the Provider — until it is cancelled or otherwise ends, and the version of these Terms in force when you bought it continues to govern that purchase. If you would rather hold your subscription on the Paddle rail, cancel the existing one (your paid access runs to the end of the period you have already paid for) and subscribe again through the current checkout. Nothing in this Section changes the price of a billing period you have already paid for.
2. Service Description
AI Game Dev provides a publicly hosted Model Context Protocol (MCP) server that acts as a bridge between MCP-compatible AI clients (such as Claude, Cursor, Windsurf, and Continue) and supported game engines. The AI Game Dev ecosystem supports multiple engines — including but not limited to Unity, Godot, and Unreal Engine (see our documentation for the full, current list of supported engines). The service relays tool calls over StreamableHTTP transport — it does not execute your code, store your project files, or modify your project directly.
2.1 Free tier vs. paid plans
The free tier provides access to the hosted MCP server only, with unlimited use. On the free tier you bring your own AI agent (for example Claude Code, GitHub Copilot, Codex, or another MCP-compatible client) and pay that AI provider directly under your own arrangement with them; your AI requests go to your chosen provider and do not pass through us. The free tier does not include AI tokens or AI compute supplied by us.
Paid plans add our proxied, metered AI tools — premium AI features, agentic workflows, and a monthly usage allowance served through our AI providers — together with account management, usage dashboards, and priority support. The specific features and allowances of each plan are described on our Pricing page.
3. Eligibility
You must be at least 13 years old to use the free Service.
To purchase or hold a paid subscription, the subscribing account holder must be at least 18 years old and have the legal capacity to enter into a binding contract, OR must be a parent or legal guardian acting on behalf of a user who is at least 13 years old, having reviewed and agreed to these Terms and authorized the purchase. By subscribing, the account holder represents that one of these conditions is met.
4. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials and API tokens.
- Raw bearer tokens are shown exactly once at creation. You must copy and store them securely — we cannot recover them.
- You are responsible for all activity that occurs under your account or tokens, including any charges incurred.
- Notify us immediately if you suspect unauthorized access by revoking compromised tokens through your dashboard.
5. Acceptable Use
You agree not to:
- Use the service to transmit malicious code, malware, or any content designed to harm systems or users
- Attempt to gain unauthorized access to the server, other accounts, or the underlying infrastructure
- Circumvent rate limits, authentication mechanisms, usage allowances, billing controls, or other security measures
- Use the service for any activity that violates applicable laws or regulations
- Resell, redistribute, or commercially sublicense access to the hosted service at ai-game.dev without prior written permission (this does not restrict your rights under the open-source licenses of the underlying code)
- Intentionally overload the service with excessive requests designed to degrade performance for other users
6. API Tokens and Authentication
Access to the MCP endpoint requires a valid bearer token when authentication is enabled. Tokens are tied to your account and subject to rate limiting. We reserve the right to revoke tokens that are associated with abusive behavior or that compromise the security of the platform.
7. Subscriptions & Billing
7.1 Paid plans
We offer one or more paid subscription plans alongside a free tier. The features, usage allowances, and prices of each plan are described on our Pricing page, which forms part of these Terms. Prices are stated in US dollars (USD) unless otherwise shown at checkout.
7.2 Billing cycle and currency
Paid plans are billed on a recurring basis — either monthly or annually, depending on the billing period you select at checkout. Your subscription begins when your first payment is successfully processed and renews at the start of each subsequent billing period.
7.3 Automatic renewal
Your subscription renews automatically at the end of each billing period until you cancel. At each renewal the payment method on file is charged the then-current price for your plan and billing period, plus any applicable taxes — by Paddle as merchant of record for subscriptions bought on or after the effective date of these Terms, and by the Provider through Stripe for legacy subscriptions (Section 1.1). You authorize these recurring charges by subscribing. You may cancel at any time (see Section 7.8) to stop future renewals.
7.4 Payment processing (Paddle)
From the effective date of these Terms, payment for new purchases is taken by Paddle as merchant of record (Section 1.1), through the Paddle checkout opened from our pricing and account pages. Card and other payment details are entered in Paddle's hosted checkout and are never transmitted to or stored on our servers. Your use of that checkout is additionally subject to Paddle's Checkout Buyer Terms and Paddle's own privacy notice.
How the charge appears on your statement. A purchase sold by Paddle shows on your card or bank statement as PADDLE.NET* MODALITH — not as "AI Game Dev". If you do not recognise a charge, please check for that descriptor and contact us before opening a dispute (see our Refund & Cancellation Policy).
Legacy subscriptions. Subscriptions created before the effective date continue to be charged by the Provider through Stripe, with the Provider as merchant of record and Stripe's own terms and privacy policy applying to that processing. Card details for those subscriptions are held by Stripe and likewise never reach our servers.
7.5 Taxes
For purchases sold by Paddle as merchant of record, Paddle calculates, collects and remits any applicable VAT, GST, sales tax or local equivalent, based on the billing location you provide at checkout. Prices are displayed according to the convention of that location:
- For consumers in the European Union and the United Kingdom, the prices shown are tax-inclusive — VAT (or the local equivalent) is already included in the displayed price.
- For customers in the United States, prices are shown tax-exclusive — any applicable sales tax is added at checkout.
The exact tax treatment for your location is shown before you confirm payment, and is set out on the invoice or receipt Paddle issues for the transaction.
Legacy subscriptions. Tax on renewals of subscriptions created before the effective date continues to be calculated and collected via Stripe Tax with the Provider as merchant of record, on the same inclusive/exclusive basis described above.
7.6 Price changes and renewal notice
We may change subscription prices from time to time. If we change the price that applies to your plan, we will give you at least 15 days' advance notice by email before the change takes effect on a future renewal. In addition, for annual plans we will send a renewal reminder by email at least 15 days before each automatic annual renewal. If you do not agree to a price change, you may cancel before the change takes effect; continuing your subscription after the change takes effect constitutes acceptance of the new price. We will not change the price of a billing period you have already paid for.
7.7 Payment failure and dunning
If a payment fails (for example, an expired or declined card), Paddle automatically retries the payment method on its retry schedule over a window of up to approximately 30 days, and may email you to ask you to update your payment details. If payment still cannot be collected by the end of that window, the subscription is cancelled automatically; we may also suspend or downgrade your access to paid features until a valid payment is received. You remain responsible for amounts owed for the period in which you had paid access. For legacy subscriptions (Section 1.1) the previous Stripe retry behaviour continues to apply.
7.8 Upgrades, downgrades, and cancellation
- Upgrade: You may upgrade to a higher plan at any time. An upgrade takes effect immediately and is prorated immediately — you are charged the difference for the remainder of your current billing period, and the full new price applies from the next renewal.
- Downgrade or change of billing period: You may downgrade to a lower plan or switch between monthly and annual billing. These changes take effect at the end of the current billing period and are prorated against the next renewal rather than charged immediately; your current plan continues until then.
- Legacy subscriptions: a subscription created before the effective date of these Terms cannot be changed in place. To move to a different plan or billing period, cancel it (your paid access runs to the end of the period you have already paid for) and subscribe again through the current checkout.
- Cancellation: You may cancel your subscription at any time from your account dashboard. Cancellation stops future automatic renewals. Your paid access continues until the end of the period you have already paid for, after which your account reverts to the free tier.
7.9 Business (B2B) purchases
If you provide a valid VAT number or other business tax identifier at checkout, you represent that you are purchasing in a business capacity (not as a consumer). In that case, consumer-specific protections — including the 14-day right of withdrawal described in Section 8 — may not apply to your purchase. Business tax identifiers are collected and validated in the Paddle checkout, and Paddle, as merchant of record, applies the EU reverse-charge mechanism (or other applicable tax treatment) where relevant, in which case the tax-inclusive pricing in Section 7.5 may not apply to your order. For legacy subscriptions (Section 1.1), business tax identifiers continue to be handled by the Provider through Stripe on the previous basis.
7.10 Extended usage and prepaid balance (wallet)
You may optionally enable extended usage, which lets you keep using the AI tools after you have exhausted your plan's monthly allowance by spending a prepaid balance ("wallet"). Extended usage is off by default and is only enabled by an explicit, affirmative action on your part; you can turn it off again at any time.
- Markup. Usage funded by your prepaid balance is billed at a +40% markup over your plan's usage rate. This markup is disclosed to you on the extended-usage screen and at the time you add funds.
- Monthly limit and reset. You set a monthly spending limit that caps how much of your balance extended usage may spend each calendar month. The limit resets at 00:00 UTC on the 1st of each month.
- Top-ups are one-time charges. Adding funds to your wallet is a one-time payment — it is not a subscription and does not auto-renew. Each top-up is a separate charge that you initiate. From the effective date of these Terms a top-up is a one-time transaction sold by Paddle as merchant of record (Section 1.1), and applicable taxes are handled as described in Section 7.5.
- First-top-up bonus. Your first wallet top-up may be eligible for a one-time +20% bonus, credited as bonus balance. The bonus is offered once per account, ever. Paid balance is always spent before bonus balance.
- Refunds. Unused paid wallet balance is refundable as described in our Refund & Cancellation Policy. Bonus balance is promotional — it is non-refundable, has no cash value, and is not exchangeable for money.
8. Refunds and Right of Withdrawal
If you are a consumer in the European Union or the United Kingdom, you have a statutory 14-day right of withdrawal for online purchases of digital services. However, because the Service is a digital service supplied immediately:
- By starting to use the paid Service during the 14-day period (which you do by beginning to use the AI tools after subscribing), you expressly request and consent to immediate performance of the Service; and
- You acknowledge that you thereby lose (or limit) your right of withdrawal once performance has begun, and that you will be charged proportionately for the AI usage already consumed. Only the unused remainder, if any, is refundable under the statutory right.
For purchases sold by Paddle as merchant of record (Section 1.1), an approved refund is issued by Paddle to your original payment method and is also subject to Paddle's Refund Policy; refunds for legacy subscriptions continue to be issued by the Provider through Stripe. In either case, your statutory rights and the proportionate-charge calculation described in our Refund & Cancellation Policy are unchanged.

9. Open Source Components
Parts of the AI Game Dev ecosystem are released as open source — the per-engine editor plugins, the engine-agnostic MCP server they share, and the .NET MCP framework beneath them. Each repository listed below is published under the Apache License 2.0:
- Unity-MCP — Unity Editor plugin
- Godot-MCP — Godot Editor plugin
- Unreal-MCP — Unreal Engine plugin
- GameDev-MCP-Server — engine-agnostic MCP server shared by the plugins above; it runs locally on your own machine
- MCP-Plugin-dotnet — .NET MCP framework
Your use of these open-source components is governed by the LICENSE file in each repository. That file is authoritative and prevails over this summary if the two ever differ. The hosted service at ai-game.dev — this website and the cloud server behind it — is proprietary and is not open source. These Terms govern your use of that hosted service, including any paid subscription.
10. Intellectual Property
You retain full ownership of your projects, source code, game assets, and any content you create using AI tools through this platform. The service does not claim any rights over your content. We do not access, store, or inspect the payloads that pass through the MCP relay.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The platform may experience downtime for maintenance, updates, or unforeseen technical issues. We will make reasonable efforts to provide advance notice of planned maintenance.
The engine plugins and the local MCP server are open source, so you can run those components yourself from the publicly available source code. This does not replace the hosted service at ai-game.dev, which is required for paid AI features.
12. Limitation of Liability
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, the Provider and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or business opportunities arising from your use of the service. To the extent liability cannot be excluded, our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless the Provider and its contributors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.
14. Termination
- You may cancel any paid subscription (see Section 7.8) and delete your account at any time.
- We may suspend or terminate your account if you violate these Terms or engage in activity that threatens the security or integrity of the platform.
- Upon termination, your API tokens will be revoked and your access to authenticated endpoints will cease. Data deletion follows our Privacy Policy.
15. Modifications to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated version number and effective date.
For material changes — including any change that affects your paid subscription, or that is required by mandatory consumer law — we will give you advance notice by email before the change takes effect and a reasonable opportunity to terminate your subscription if you do not accept the change. We will not rely on "continued use means acceptance" alone for material changes. For non-material changes, continued use of the service after the changes take effect constitutes acceptance of the updated Terms. In all cases, your mandatory statutory rights as a consumer (see Section 17) are unaffected.
16. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the service shall be resolved through good-faith negotiation for a period of at least 30 days, and if unresolved, through binding arbitration or the courts located in Washington State.
17. Your Statutory Consumer Rights
Nothing in these Terms limits or excludes any mandatory statutory rights you have as a consumer that cannot be waived under the law of your country of residence. Where a provision of these Terms conflicts with such a non-waivable right, that mandatory right prevails to the extent of the conflict, and the remainder of these Terms continues to apply.
